Terms of use
What you allow in your mailbox, what the free plan includes, and what each side can expect of the other.
What these terms cover
WarmupBay is a free email warmup service. It is operated by Reto Odoni, Weststrasse 133, 8003 Zürich, Switzerland (“we”). These terms apply to the website warmupbay.com and to the service. By creating an account you accept them.
Who can use the service
The service is made for people who send email for their work. You must be at least 18 years old. The details in your account must be true, and you keep your password to yourself. One person has one account.
What you allow in your mailbox
When you connect a mailbox, you allow WarmupBay to sign in to it and to do the following by itself:
- send short warmup emails to other participating mailboxes and receive theirs
- look for warmup emails in the inbox and the spam folder, mark them as read, reply to some of them and file them in the place you chose
- keep a copy of the messages in the main folders in sync with our server, as described in the privacy policy
You confirm that the mailbox is yours, or that its owner has allowed you to connect it. That includes an employer whose mailbox you use.
You can end the access at any time: disconnect the mailbox in the app, and delete the app password at your provider or change the mailbox password.
Your email provider's rules
Your mailbox stays subject to the terms of its provider. No public policy of Google or Microsoft names email warmup. Their general rules on automated use and on spam apply, and a provider can read or change them in a way that affects warmup.
Whether you use warmup with a mailbox is your decision and your risk. We cannot promise that a provider accepts it, and we are not responsible if a provider limits or blocks a mailbox.
The free plan
- 10 warmup emails a day for each mailbox, or up to 30 a day with a verified badge.
- One mailbox for each account.
- No charge, no trial period, no payment details.
The free plan is meant to stay. We can adjust the limits when running the pool requires it. If paid options are ever added, they start only when you order them. Nothing turns into a paid plan by itself.
The badge
The badge is optional. It raises your daily limit under these conditions:
- It is on a public page of a website you run, where visitors can see it.
- The code is used unchanged, including the attributes
sponsored nofollowon the link. - A website counts for one mailbox.
The higher limit applies after a check has found the badge. A successful check holds for 72 hours and is renewed by the next one. If the badge is no longer found, the limit returns to 10 emails a day. You can remove the badge whenever you like.
What a mailbox needs
The domain of a connected mailbox needs SPF, DKIM and DMARC records. If they are still missing 72 hours after connecting, warmup stops until they are in place.
To protect the other participants, the service can slow down, pause or remove a mailbox from the pool, for example when its emails land in spam often, when signing in fails or when there are signs of misuse.
What is not allowed
- using the service for anything unlawful, or to prepare the sending of unsolicited bulk email that the law of the recipients' country forbids
- connecting a mailbox you are not entitled to use
- marking the warmup emails of other participants as spam, blocking their senders or reporting them
- opening several accounts to get around the limits
- hiding the badge from visitors while claiming the higher limit
- disturbing the service, testing it for weaknesses without our consent, or reading out data of other participants
Data we process on your behalf
Your mailbox contains personal data of other people. For that data you are the responsible party, and we process it on your behalf. This section is the agreement between us for that processing (Art. 9 of the Swiss Data Protection Act and, where it applies, Art. 28 GDPR).
- Purpose: we process the content of the mailbox only to provide the service described in these terms, and not for purposes of our own.
- Confidentiality and security: we keep it confidential and protect it as described in the privacy policy.
- Others involved: the server is run by Hetzner Online GmbH in Helsinki, Finland. We tell you before another provider is added.
- Requests and incidents: we help you answer requests from people whose data is concerned, and we tell you without delay if that data is affected by a security incident.
- End: when you disconnect the mailbox or delete your account, we delete the data.
Availability and changes
The service is free and comes without a promise of availability. It can be interrupted for maintenance or by faults. We develop it further and can change or remove functions.
If we end the service altogether, we announce it at least 30 days ahead in the app or by email.
No promised result
Warmup is one of several things that decide where your emails land. We do not promise a place in the inbox, a certain sender reputation or a certain result of your own sending. The numbers in the app are measured inside the pool and describe what happened to warmup emails.
Liability
We are liable without limit for damage we cause intentionally or through gross negligence, and wherever the law does not allow liability to be limited. Beyond that, liability is excluded as far as the law permits. This applies in particular to indirect damage, lost profit, lost data and measures a mailbox provider takes against a mailbox.
Ending
You can delete your account at any time in the app under “Account”. That disconnects your mailboxes and removes your data.
We can suspend or close an account that breaks these terms or endangers the pool. Where it is reasonable, we say so first and give you the chance to put it right.
Changes to these terms
We can change these terms when the service or the law changes. We announce changes that matter in the app or by email at least 14 days before they apply. If you keep using the service after that date, the new terms apply. If you do not agree, you can delete your account.
Law and courts
Swiss law applies. The courts of Zürich are competent, unless the law gives you as a consumer the right to a court at your place of residence.
These terms exist in English and German. If the two differ, the German version applies.
